The Municipal Court Practice Group

The municipal courts of New Jersey can handle certain disorderly persons drug offenses:

• N.J.S.A. 2C:5-10(a)(4), possession of marijuana under 50 grams;

• N.J.S.A. 2C:35-10(b), using or being under the influence of CDS

• N.J.S.A. 2C:35-10(c), failure to deliver CDS to police;

• N.J.S.A. 2C:36-2,  possession of drug paraphernalia

PENALTIES:

• FINE: $500.00 to $1000.00 Drug Enforcement Penalty

LOSS of LICENSE:

• INCARCERATION: Up to 56 Months

OTHER PENALTIES:

• $50.00 lab fee

• $50.00 fine to the Violent Crimes Compensation Board

• $30.00 fine to Law Enforcement Officers Training and Equipment Fund

• $75.00 Safe Neighborhood Services Fund assessment

• Community Service

• Probation for up to two(2) years with counseling and random urine testing
