Operating a Vehicle without Insurance

Operating a vehicle without insurance is a violation of N.J.S.A. 39:6B-2. The penalties are severe, and the State places the burden on the defendant to prove that he was in fact insured. If you cannot produce a valid insurance card at the time of a motor vehicle stop, then it is presumed that you are uninsured. The penalties are as follows:

B. FIRST OFFENSE: 

  • FINE: $300.00-$1000.00 

  • LOSS OF LICENSE: One year 

  • OTHER PENALTIES: Community service in the discretion of the court. 

B. SECOND (OR SUBSEQUENT) OFFENSE 

  • FINE: Up to $5,000 

  • LOSS OF LICENSE: Two years 

  • INCARCERATION: 14 days 

  • OTHER PENALTIES: 30 days community service
